Agreement

By accessing beatthemarket.ai or subscribing to Beat The Market, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the platform.

These Terms constitute the entire agreement between you and Beat The Market with respect to your use of the platform, and supersede all prior agreements and understandings.

What Beat The Market Is

Beat The Market is a subscription-based financial information service. We publish AI-generated investment strategy rankings and stock scoring data for educational and informational purposes. We are not a registered investment adviser, broker-dealer, financial planner, or portfolio manager under any applicable law.

Nothing on this platform constitutes personalised investment advice, a solicitation to buy or sell any security, or a recommendation tailored to your individual financial circumstances. All investment decisions are made solely by you, and you are solely responsible for those decisions.

Users access the platform for informational purposes only and execute all trades independently through their own brokerage accounts. Beat The Market does not hold, manage, or have access to user funds at any time.

Eligibility

You must be at least 18 years of age to use this platform. By agreeing to these Terms, you represent that you are at least 18 years old. The platform is intended for users in the United States. We make no representation that the platform is appropriate or available for use in other jurisdictions.

Subscriptions and Billing

Pricing. The platform is available for $9.99 per month. We reserve the right to change our pricing at any time. If we change the price of your subscription, we will provide you with at least 30 days' notice by email before the change takes effect. Your continued use of the platform after the price change takes effect constitutes your agreement to the new price.

Billing. Subscriptions are billed monthly on a recurring basis through our payment processor, Stripe. Your payment method will be charged on the same calendar date each month from the date you first subscribe. You authorise us to charge your payment method on a recurring monthly basis until you cancel.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the platform until that date. We do not issue partial refunds for unused time within a billing period.

Failed payments. If a payment fails, we will make reasonable attempts to collect payment. If payment cannot be collected, your access to the platform may be suspended until the outstanding amount is settled.

Acceptable Use

You agree not to:

• Share your account credentials with any other person or allow any other person to access the platform using your account.
• Scrape, copy, reproduce, or redistribute our strategy rankings, stock scores, or any other platform content for any commercial purpose.
• Use the platform in any way that violates applicable law, including securities laws, or that infringes the rights of any third party.
• Attempt to reverse-engineer, decompile, or circumvent any aspect of the platform or its underlying systems.
• Use automated tools, bots, or scripts to access the platform without our prior written consent.

Intellectual Property

All content on the platform — including but not limited to strategy rankings, AI-generated scores and analysis, written content, visual design, and software — is owned by or licensed to Beat The Market and is protected by applicable intellectual property laws.

Your subscription grants you a personal, non-exclusive, non-transferable licence to access and use the platform for your own personal, non-commercial purposes during your active subscription period. No other rights are granted. You may not sublicence, sell, or otherwise transfer your access rights to any third party.

Disclaimers

The platform and all content on it are provided "as is" and "as available" without warranty of any kind, express or implied. We make no warranty that strategy rankings, stock scores, or AI-generated analysis will be accurate, complete, timely, or suitable for any particular purpose. We make no warranty that the platform will be uninterrupted, error-free, or free of harmful components.

Past performance data displayed on the platform, where applicable, is provided for informational purposes only and does not guarantee or predict future results. Market conditions change rapidly, and no ranking or score should be interpreted as a guarantee of investment return.

Limitation of Liability

To the fullest extent permitted by applicable law, Beat The Market and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the platform, including but not limited to investment losses, lost profits, or loss of data, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the platform is limited to the total amount you paid to Beat The Market in the three calendar months immediately preceding the event giving rise to the claim.

Changes to These Terms

We may update these Terms at any time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cancel your subscription before the changes take effect.

Termination

We reserve the right to suspend or terminate your access to the platform at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your licence to use the platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — shall survive.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.
